Contributor Licence Agreement
1. What this agreement covers
1.1. This agreement is between you and JĂșlia Klee, who runs the WolOS project and WolOS Hub ("we"). Words such as "hub", "account", "organisation", "Content" and "Work" have the meanings in the Terms of Use, section 2.
1.2. It covers two things:
- Contributions: code, documentation, translations, artwork, designs and any other material you send to a WolOS repository, by pull request, patch, issue, comment or any other way, with the intent that it becomes part of WolOS.
- Hub content: what you send to the hub (listing text, release notes, icons, screenshots, reports, answers).
1.3. It does not cover your Work listed on the hub. Your Work stays under its own licence. The Publisher Agreement covers listing it.
1.4. If you send a contribution for an organisation, you accept this agreement for yourself and, if an owner of the organisation accepted it on the hub, for the organisation too.
2. You keep your copyright
You keep every right you have in your contributions. This agreement does not transfer copyright to us or to anyone.
3. The licence you give
3.1. For each contribution, you give us and everyone who receives WolOS a licence under the licence of the file or repository the contribution goes into, as stated in that repository (for example the GNU General Public License version 2 or any later version, or the BSD 2-Clause licence for libraries that use it).
3.2. If the file or repository states no licence, your contribution is licensed under the GNU General Public License, version 2 or any later version ("GPL-2.0-or-later").
3.3. This licence is worldwide, free of charge, non-exclusive and cannot be revoked for what was already published, as the licence itself provides.
3.4. We do not ask for any right to relicense your contribution under terms the repository's licence does not allow. Code under GPL-2.0-or-later may be used under a later version of the GPL because that is what "or later" means.
3.5. For hub content, you give the licence in section 8.2 of the Terms of Use.
4. Patents
4.1. You give no patent licence beyond what the licence in section 3 itself gives. If the licence gives none, this agreement gives none.
4.2. Nothing in this agreement asks you to give up, assign or license any patent in any other way.
5. What you promise
5.1. Originality. Each contribution is your own original work, or you have the right to send it under section 3.
5.2. Other people's work. If a contribution contains material made by others, you mark it clearly, with its author, its licence and where it came from, and that licence allows it to be used under section 3.
5.3. Employer and clients. If an employer, a client, a school or anyone else has rights in what you make, you have their permission to send the contribution under this agreement, or they have given up their rights in it. If this changes, you tell us before your next contribution.
5.4. No known problems. To your knowledge, the contribution does not infringe anyone's copyright, patent, trade mark, trade secret or other rights, and contains nothing you know to be malicious.
5.5. Accuracy. You tell us if you learn that any of these promises is no longer true.
5.6. Export. You may lawfully send the contribution to a public repository, and publishing it there breaks no export control or sanctions law that applies to you (Terms of Use, section 21.9).
5.7. You make these promises only as far as you know, in good faith. Except for these promises, you give your contribution as it is, with no warranty.
6. Moral rights
6.1. Moral rights are an author's personal rights, such as the right to be named and to object to changes that harm their honour.
6.2. Where the law lets you, you agree not to use your moral rights to stop normal changes, translations, fixes and adaptations of your contribution made under its licence.
6.3. Where the law does not let you give them up or agree not to use them (for example in Brazil, Lei 9.610/1998, article 27, and in many EU countries), they stay fully yours, and we respect them. We keep your name in the history of the repository and in the credits the repository keeps.
7. What we may do, and what we do not promise
7.1. At our sole discretion, at any time, with or without giving a reason, we may accept, change, reject, revert or remove any contribution. We have no duty to review it, merge it, use it, ship it or keep it.
7.2. Contributions are welcome only under the Wonderland Doctrine. Section 7 of the Doctrine applies: we may decline contributions from people who behave in ways it does not allow, and limit or end their access to WolOS repositories and to the hub.
7.3. We do not pay for contributions, and you do not pay us.
7.4. All rights reserved. This agreement gives us only the licence in section 3. It gives you no right in the WolOS names or logos (see the Trade Mark Policy) or in anything else of ours, except what the licence of each repository gives everyone.
7.5. No warranty from us. WolOS, its repositories and the hub come "as is" and "as available", without warranty of any kind, as their licences and sections 14 and 15 of the Terms of Use say. Checked never means harmless.
8. How you accept
8.1. You must be 16 or older to accept this agreement. You accept it when you sign in to the hub with your GitHub account and press the accept button next to this text, or when a WolOS repository asks you to accept it through the hub before it takes your first contribution.
8.2. When you accept, the hub records your GitHub numeric id, the version of this agreement, the SHA-256 hash of the exact text you were shown, and the time. That record is your signature. It works as an electronic signature under the laws of Brazil, the EU and the US.
8.3. An organisation accepts when one of its owners links it to the hub and accepts this text for it. The record names the owner who accepted.
8.4. A new version applies only after you accept it. Until then, your earlier contributions stay under the version you accepted. The hub asks you to accept the new version before your next contribution or action that needs it.
9. Ending
9.1. You can stop contributing at any time. The licence for contributions already published stays, because the licence itself says so.
9.2. This agreement continues for contributions you sent while it applied.
9.3. Survival. Sections 2, 3, 4, 5, 6, 7.4, 7.5, 9 and 10 continue after you stop contributing or your access ends.
10. Law
10.1. Sections 14 and 15 (disclaimers and limits), 16 (your responsibility, for hub content), 18 (law and courts, including individual claims only where enforceable) and 21 (general: severability, no waiver, assignment, entire agreement, events beyond our control, export control) of the Terms of Use apply to this agreement, including the protections for consumers in Brazil, the EU and US states.
10.2. This agreement and the Terms of Use are the whole agreement about contributions. We may transfer this agreement, and the licences you gave under it, to a person or legal entity that takes over the WolOS project; the licences stay the same.
10.3. Questions and notices: julia@wolos.org, our designated contact.
